The aim of the targeted campaign ‘Identification of pistachios in confectionery’ was to examine products containing pistachios – which, according to their packaging or product information, were made from or with pistachios – to determine whether they were misleading or adulterated with other nuts or peas, and/or whether they contained only flavourings and colourings.
Fifty samples were analysed, of which seven were found to be non-compliant:
- Two samples were assessed as harmful to health in accordance with the LMSVG (Federal Law on Food Safety), Federal Law Gazette I No. 13/2006, as amended, due to high, undeclared levels of peanuts
- Two samples were rejected due to non-compliance with allergen labelling requirements in accordance with the Allergen Information Regulation (BGBl. II No. 175/2014, as amended)
- Two samples were rejected on the grounds of misleading labelling in accordance with Article 7(1)(a) of Regulation (EU) No 1169/2011 (LMIV), as the composition of the declared ingredients did not correspond to the ingredients determined by analysis
- One sample was rejected
due to the use of a colouring agent not authorised for that product category in accordance with Regulation (EC) No 1333/2008 on food additives
