Final Report of Priority Action A-950-21

Foods for special medical purposes (FSMP) are designed for special groups of patients whose nutritional needs cannot be met by the consumption of normal foods due to certain diseases, disorders or specific medical conditions. Before being placed on the market, they must be registered with the relevant department. This focus action served to review the situation on the Austrian market.

Seven samples from all over Austria were examined:

  • Three samples did not comply with the requirements for FSMPs due to their material composition (= content of value-determining constituents per daily consumption amount), as they were to be assessed as food supplements.
  • In addition, two of these samples did not meet the labeling requirements for FSMP due to their intended use.
  • One of the three samples had to be additionally objected - due to labeling deficiencies - according to the Food Information Regulation - LMIV, (EU) No. 1169/2011.
